ECVS Terms & Conditions

These Terms & Conditions apply to bookings made with ECVS for wedding, prom and special occasion vehicle hire.

By making a booking with ECVS, you agree to these Terms & Conditions.

1. About ECVS

ECVS provides luxury and classic vehicle hire for weddings, proms and special occasions.

Our vehicles may include classic, luxury and prestige cars. The vehicle supplied will be the vehicle agreed at the time of booking, subject to availability and the provisions of these Terms & Conditions.

2. Making a Booking

A booking is only confirmed once ECVS has accepted the booking and the required booking payment or deposit has been received.

An enquiry or provisional reservation does not constitute a confirmed booking.

Once your booking has been confirmed, we will provide you with confirmation of the agreed:

  • Date

  • Vehicle

  • Hire period

  • Collection and/or destination details

  • Price

  • Deposit or booking payment

  • Any additional services agreed

Customers should check their booking confirmation carefully and notify ECVS as soon as possible if any information is incorrect.

3. Prices and Payment

The price of your booking will be confirmed at the time of booking.

Any additional services, extra mileage, additional waiting time or other charges agreed after the original booking may incur additional costs. Any additional charges will be discussed with you where reasonably practicable before they are incurred.

The remaining balance must be paid by the date specified by ECVS.

If the balance is not paid by the agreed date, ECVS may contact you to arrange payment. Continued failure to pay may result in the booking being cancelled, subject to applicable consumer rights.

4. Deposits and Booking Payments

Where a deposit or booking payment is required, the amount and payment deadline will be confirmed at the time of booking.

Deposits and advance payments may be used to secure the vehicle and date for your booking and to cover reasonable costs incurred in preparing for and reserving the service.

If you cancel your booking, any amount retained by ECVS will be assessed in accordance with these Terms & Conditions and applicable consumer law.

We will not seek to impose a cancellation charge that is disproportionate to our reasonable losses.

5. Cancellation by the Customer

If you need to cancel your booking, you should contact ECVS as soon as possible.

Cancellation requests should be made in writing by email where possible.

Depending on how far in advance the cancellation takes place, ECVS may be entitled to retain some or all of the booking payment to cover reasonable losses arising from the cancellation.

Where appropriate, ECVS will take reasonable steps to reduce its losses, including attempting to re-book the vehicle for the cancelled date.

Any refund due will be confirmed following cancellation.

Nothing in these Terms & Conditions affects any cancellation rights you may have under applicable consumer law.

6. Cancellation or Changes by ECVS

We will make every reasonable effort to provide the vehicle and service agreed at the time of booking.

However, ECVS may occasionally need to cancel or make changes to a booking due to circumstances outside our reasonable control, including:

  • Mechanical failure

  • Accident or damage to the vehicle

  • Unexpected safety concerns

  • Severe weather

  • Road closures

  • Emergency situations

  • Illness or unavailability of a driver

  • Other circumstances that make providing the agreed service unsafe or impractical

Where possible, we will offer a suitable alternative vehicle or alternative arrangement.

If ECVS is unable to provide the agreed service and no suitable alternative is accepted, you will be entitled to any refund required by law.

7. Vehicle Substitution

Our vehicles are classic and specialist vehicles and, despite regular servicing and maintenance, unexpected mechanical problems can occur.

If the vehicle originally booked becomes unavailable, ECVS will make reasonable efforts to provide a suitable alternative vehicle.

The replacement vehicle may differ in make, model, colour or specification.

Where a suitable alternative cannot be provided, ECVS will discuss the available options with you.

8. Vehicle Condition and Appearance

ECVS vehicles are maintained and presented to a high standard.

As classic and specialist vehicles, some vehicles may have age-related characteristics or minor imperfections that are consistent with their age and character.

We will ensure that vehicles are appropriately clean and presentable before the booking.

9. Timing and Delays

Customers are responsible for providing accurate collection, ceremony, venue and destination information.

Customers should allow sufficient time for their journey and event schedule.

ECVS will make reasonable efforts to arrive at the agreed collection time. However, delays caused by traffic, road closures, accidents, weather or other circumstances outside our reasonable control may occur.

Where we become aware of a significant delay, we will make reasonable efforts to contact you.

10. Waiting Time

The hire price includes the time specifically agreed at the time of booking.

Additional waiting time requested by the customer may be subject to an additional charge.

Any additional waiting charges will be explained where reasonably practicable.

11. Customer Conduct

Customers and passengers must behave responsibly and respectfully while using an ECVS vehicle.

ECVS reserves the right to refuse or terminate a journey where a passenger's behaviour creates a genuine risk to the driver, vehicle, passengers or other road users.

This may include:

  • Aggressive or threatening behaviour

  • Excessive intoxication

  • Deliberate damage to the vehicle

  • Failure to follow reasonable safety instructions

  • Any behaviour that creates a safety risk

Where a journey is terminated because of customer behaviour, this will not normally entitle the customer to a refund, subject to applicable law.

12. Damage to Vehicles

Customers are responsible for damage caused to an ECVS vehicle by themselves or members of their party where the damage results from unreasonable, negligent or deliberate behaviour.

This may include damage caused by:

  • Spilling food or drinks

  • Excessive mess

  • Smoking or vaping

  • Damage to seats, carpets or interior fittings

  • Deliberate damage

  • Other negligent or inappropriate behaviour

ECVS will provide details of any reasonable repair, cleaning or replacement costs claimed.

We will not charge customers for ordinary wear and tear or damage that was not their responsibility.

13. Smoking and Vaping

Smoking and vaping are not permitted inside any ECVS vehicle.

Customers may be responsible for reasonable cleaning or repair costs resulting from smoking or vaping inside a vehicle.

14. Food and Drink

Food and drink should not be consumed inside an ECVS vehicle unless specifically agreed in advance.

Alcohol must not be consumed inside an ECVS vehicle unless expressly agreed by ECVS and legally permitted.

15. Child Seats and Passengers

Customers must tell ECVS in advance if children will be travelling in the vehicle.

Where a child seat is required, the customer is responsible for ensuring that an appropriate legally compliant child seat is available and correctly fitted unless ECVS has specifically agreed otherwise.

All passengers must comply with applicable seatbelt and passenger safety requirements.

16. Photography and Events

Customers are welcome to take photographs of ECVS vehicles during their booking, provided that this does not create a safety risk or interfere with the operation of the vehicle.

If the vehicle is being used for photography, additional time or special arrangements should be agreed with ECVS in advance.

17. Weather

Our vehicles may be used in normal weather conditions.

In exceptional weather, including severe snow, flooding, ice, extreme winds or other conditions where travelling would create an unreasonable safety risk, ECVS may need to alter, postpone or cancel a booking.

Where this occurs, we will communicate with the customer as soon as reasonably practicable and discuss available options.

18. Events Outside Our Control

ECVS will not be responsible for failure or delay in providing the service where this is caused by circumstances outside our reasonable control.

This may include:

  • Extreme weather

  • Road closures

  • Traffic incidents

  • Accidents involving third parties

  • Government restrictions

  • Natural disasters

  • Emergency situations

  • Vehicle breakdowns despite reasonable maintenance

  • Driver illness

  • Other unforeseeable circumstances

Where such circumstances occur, ECVS will make reasonable efforts to minimise the impact on your booking.

19. Customer Responsibilities

Customers are responsible for providing ECVS with accurate information, including:

  • Correct addresses

  • Collection and destination locations

  • Event times

  • Contact details

  • Number of passengers

  • Any special requirements

Customers should notify ECVS as soon as possible if any booking details change.

We cannot guarantee that changes requested at short notice can be accommodated.

20. Insurance and Legal Requirements

ECVS vehicles are operated in accordance with applicable legal and insurance requirements.

Customers must comply with reasonable instructions given by the driver or ECVS representative.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.

21. Liability

ECVS will provide its services with reasonable care and skill as required by applicable consumer law.

Nothing in these Terms & Conditions limits or excludes your statutory rights.

ECVS will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control, subject to applicable law.

Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot legally be excluded or limited.

22. Complaints

We want every customer to have a positive experience.

If you are unhappy with any aspect of our service, please contact ECVS as soon as possible so that we have the opportunity to investigate and resolve the matter.

Complaints should be sent to us in writing where possible and should include your booking details and a description of the issue.

We will review complaints fairly and respond within a reasonable timeframe.

23. Privacy

Personal information provided to ECVS will be handled in accordance with our Privacy Policy.

24. Website Information

We make reasonable efforts to ensure that information on the ECVS website is accurate and up to date.

Vehicle availability, specifications, photographs and descriptions may change from time to time.

Photographs are provided for illustration and may not always represent the exact vehicle configuration or condition at the time of booking.

25. Changes to These Terms

ECVS may update these Terms & Conditions from time to time.

The Terms & Conditions applicable to your booking will be those provided or made available to you at the time your booking is confirmed, unless a change is required by law or agreed with you.

26. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be dealt with by the courts of England and Wales, subject to any applicable consumer rights.

27. Your Statutory Rights

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

Where ECVS provides services to consumers, those services will be provided in accordance with applicable consumer protection legislation, including the Consumer Rights Act 2015. Services must be provided with reasonable care and skill, and contractual terms must be fair and transparent.
